Illegal placement of communication cables on power lines may violate the rights of bona fide consumers

On 26 March, specialists from IDGC of Centre - Voronezhenergo division (included into ROSSETI’s Group) dismantled the insulated wire illegally placed on power line poles of the company in the settlement of “Ozerki” of Rossoshansky district of the Voronezh region. The dismantling was carried out in the presence of local governments and law enforcement agencies without damaging someone else’s property.

Since the beginning of this year, Voronezhenergo’s specialists have revealed the noncontractual placement of cables of fiber-optic communication lines (FOCL) at more than 2 thousand power supply facilities of the company.

According to clause 8 of the Rules for the establishment of protected zones of electric grid facilities and special conditions for the use of land plots located within the borders of such zones, approved by Resolution of the Russian Federation Government No. 160 of 24 February 2009, it is prohibited to perform any actions that may violate safe operation of electric grid facilities, including damage or destruction, and (or) entail harm to life, health of citizens, and property of individuals or legal entities, including connecting foreign objects to wires and poles, as well as to climb overhead power line poles.

Unauthorized suspension of third-party equipment at electric grid facilities without prior approval from power engineers makes it difficult to perform maintenance and emergency repair work on overhead power lines, and, as a result, may lead to a power failure of consumers, as well as accidents. Work on dismantling equipment placed on overhead power lines without a contract requires additional involvement of labour and equipment, as well as being carried out with de-energizing power lines. Persons carrying out unauthorized suspensions not only put their lives at undue risk and interfere with the operation of the power system, but also violate the rights of the owner of the power grid infrastructure, as well as cause inconvenience to bona fide electricity consumers.

Voronezhenergo draws special attention of fiber optic cable owners to the fact that disagreement with the established tariff for providing access to the infrastructure of IDGC of Centre for placing telecommunication networks is not a legal basis for the non-contractual use of someone else’s property for profit. Disputes and disagreements arising between business entities should be resolved exclusively in the legal field, without violating the rights and interests of third parties.

The branch intends to continue the consistent work to prevent unauthorized use of electric grid infrastructure facilities.
