For 11 months of 2018, specialists of IDGC of Centre - Belgorodenergo division identified and suppressed in the region more than 600 facts of non-metered electricity consumption totalling 9.4 million kWh. Damage from illegal consumption exceeded 25.5 million rubles.
The volume of non-contractual electricity consumption is calculated in accordance with Resolution of the Government of the Russian Federation of 04.05.2012 No. 442, based on the cable carrying capacity that was connected, that is, from the value of long-term current load of each input wire, and during the period of time of non-contractual consumption. For residential consumers the cost of non-metered consumption, as a rule, translates into hundreds of thousands of rubles, for businesses - into hundreds of thousands or even millions of rubles.
A resident of Yakovlevsky district from the village of Kalinino had to pay for electricity about 150 thousand. He connected to the grid illegally, but during the trial, he fully admitted his guilt. One hundred seventy five thousand rubles should be paid this year by a resident of the village of Dmitrievka in Yakovlevsky district for unauthorized connection to the grid, which caused the branch considerable damage. On 15 December of this year, the decision of the Alexeevsky District Court on unauthorized connection to the grid of a resident of the Babichev Farm enters into force. The claim of the branch for collection of 131 thousand rubles from the violator was fully satisfied.
Non-contractual and non-metered consumption of electricity, or simply theft, is legally attributed to facts of unlawful enrichment, which implies both administrative and criminal responsibility. The consumer will have to pay an administrative fine in the amount of 15 thousand to 200 thousand rubles (Article 7.19 of the Administrative Code of the Russian Federation). If the consumer refuses to voluntarily compensate for losses incurred by the company, the energy company will go to court, after which the violator will have to compensate for legal costs.
In the event a crime is committed by a group of persons in a preliminary conspiracy or by an organized group, if, for example, the violator is a legal entity, and also, if the damage is classified as “particularly large”, criminal liability is provided in the form of imprisonment for up to five years (Article 165 Part 2 of the Criminal Code of the Russian Federation).
Diligent consumers, who regularly pay electricity bills, who may experience power surges and failure of household appliances, suffer from criminal actions of thieves.
