For the first half of the year 2018, courts satisfied 11 lawsuits filed by IDGC of Centre - Lipetskenergo division for rendered services for electricity transmission. As a result, 334 million rubles were returned to the company, including 69 million as interest and penalties for late fulfillment of contractual obligations. Part of the judicial acts on recovery of money from debtors are at the stage of appeal in arbitration courts of various instances.
Thus, the supplier of last resort - Lipetsk energy sales company, refused to pay for electricity transmission services rendered by Lipetskenergo in 2016. Since the beginning of 2018, 7 lawsuits filed by the branch have been reviewed, which resulted in the issuance of judicial acts in favour of Lipetskenergo to recover more than 300 million rubles from the supplier of last resort.
The joint-stock company "Dolomit" disputed the legality of the non-metered consumption act drawn up by Lipetskenergo back in 2014, the amount of debt on which exceeded 2.5 million rubles. The court refused to satisfy the requirements of the consumer. The process passed two instances, confirming the correctness of the power engineers.
Dankovsky Dairy Plant also tried unsuccessfully to challenge the act of non-metered electricity consumption in the Arbitration Court of Central District. Now it has to pay more than 1 million 300 thousand rubles.
The Lipetsk regional water authority lost the case to Lipetskenergo in the amount of 468 thousand rubles. The regional state enterprise unauthorizedly connected to the electric supply wells in Lipetsky and Dobrovsky districts.
"It is important to understand that the money that enterprises do not pay for the consumed energy resources is, in fact, failed repairs of power facilities in the Lipetsk region. Today, the total debt of unscrupulous consumers exceeded the amount that Lipetskenergo spends annually on reconstruction and construction. And the most unpleasant thing is that the list of debtors is headed by the electricity supplier of last resort in the region OJSC "LESK". Its debt has reached two billion rubles, and this despite the fact that we recovered 600 million through the court," said Larisa Burlakova, the head of the legal support department of IDGC of Centre - Lipetskenergo division.
Currently, there are 74 lawsuits of the branch in the courts with respect to unscrupulous consumers of electricity transmission services for a total amount of 1 billion 900 million rubles.
