Kurskenergo through the court terminated a grid connection contract because of the applicant’s failure to comply with the technical conditions

IDGC of Centre - Kurskenergo division through the court could terminate a grid connection contract with LLC "EkoInvestProject" due to the failure of the applicant to comply with the technical conditions. The enterprise did not perform the activities for grid connection within the boundaries of its site. Now it is to pay the power company damages exceeding 82 thousand rubles, as well as court expenses for payment of state duty in the amount of 9,280 rubles.

In 2012, LLC "EkoInvestProject" applied to Kurskenergo for connection to the grid of an incoming line section of a 10/0.4 kV transformer substation being designed, which was supposed to supply power to a waste sorting and processing facility in Kursk district of the Kursk region.

The contract was signed in January 2013. Kurskenergo timely fulfilled all the activities necessary for the grid connection of the applicant’s power installations, which was notified by a letter.

However, LLC "EkoInvestProject", in turn, did not fulfill its part of the activities stipulated by the grid connection agreement and the technical conditions for it. Nor did the company respond to Kurskenergo’s letter with a proposal to terminate the agreement on the implementation of the connection to the electric grid, as well as to reimburse the losses incurred by the branch.

The applicant’s evasion from fulfilling his obligations under the grid connection agreement served as the basis for the appeal of the power engineers to the Arbitration Court of the Kursk region, which decided to terminate the agreement.

At present, two more lawsuits of Kurskenergo on termination of the grid connection contract and compensation of damages for a total of 281,941.14 rubles are being considered in the Arbitration Court of the Kursk region and in the court of the city of Kurchatov. In the first case, the respondent is JSC "Gazprom Gas Distribution Kursk", in the second - a private entrepreneur.

In total, from January to September 2017 inclusive, 143 applicants did not fulfill their obligations under grid connection agreements. They either were not ready to be connected, or they did not contact the grid company at all.

"Kurskenergo incurs financial and time losses by investing in construction and reconstruction of power grids and power facilities that can be used for grid connection of potential customers, who are really interested in connecting to power grids," stressed Deputy Director for Sale and Development of Services of IDGC of Centre - Kurskenergo division Sergey Sevryukov. "Therefore, we will take all measures provided for by law to those applicants, who do not systematically comply with the terms of the grid connection agreement."
