IDGC of Centre sent a statement to the prosecutor’s office of the Lipetsk region, the Office of Internal Affairs of the region and the Inter-regional Office of the Federal Financial Monitoring Service of the Central Federal District to check the activities of OJSC "LESK" for the presence in the actions of the management of an offense under the Criminal Code of the Russian Federation.
As reported earlier, as of 1 July 2016 the value of outstanding receivables of the supplier of last resort of the Lipetsk region OJSC "Lipetsk Energy Retail Company" (LESK) to IDGC of Centre amounted to 1.7 billion rubles, which corresponds to 5 months of service cost of electric power transmission.
IDGC of Centre pointed out that deliberate actions on the part of the management of OJSC "LESK" contribute to the formation of this debt to a great extent, who does not want to settle legal relations with counterparties, which further leads to making unlawful acts against the company.
In particular, in connection with the termination of payment for energy by such a consumer as OJSC "LMZ Svobodny Sokol", OJSC "LESK", using the status of supplier of last resort, in 2013 unilaterally terminated the contracts of power supply with the said consumer, whose grids "nondisconnectable" socially significant facilities are connected to. That is, if you turn off the power supply centre, supplying electricity to the company, then there will be no electricity for a thousand dwellers of the settlement of Sokol, where metallurgists reside and there are hospitals, kindergartens and schools. Given the current situation, in which, together with the disconnected enterprise there would be also socially important facilities turned off, and the settlement residents, IDGC of Centre continued in a forced way to supply electricity to OJSC "LMZ Svobodny Sokol". As a result, the entire amount of electricity delivered OJSC "LESK" self-willed attributed to technical losses and unilaterally set off, causing damage to IDGC of Centre on a large scale.
Similarly, OJSC "LESK" acted in relation to district water utilities, which had debt for electricity, terminating unilaterally supply contracts with them. However, Lipetskenergo did not disconnect sewage and pumping stations from power supply since otherwise residents of the region could be with no water. Moreover, these facilities are included in the list, approved by Governor of the Lipetsk region (Decree №329 from 30.06.2015), the restriction of which could lead to economic, social consequences. The jurisprudence confirms that the supplier of last resort had no legal grounds for the termination of supply contracts with the consumers.
Experts of the security unit of IDGC of Centre perceive malpractice and arbitrariness of the management of OJSC "LESK" in the above facts. And in this connection the statements were sent to the relevant regulatory authorities to check OJSC "LESK".
