On a voluntary basis and following the results of legal proceedings in 2017, 298 violations of protection zones of power lines were eliminated in the service area IDGC of Centre - Belgorodenergo division.
Claims against individuals and legal entities that violated the requirements of RF Government Resolution No. 160 of 24.02.2009 "On the procedure for establishing protection zones for electric grid facilities ..." are considered in district and city courts, as well as in the Regional Arbitration Court. Most often, citizens at their own expense have to demolish fences, garages, greenhouses and even residential buildings built without agreement with the power grid company and posing a threat to the population.
So, by the decision of the Regional Arbitration Court last year, the sports and playgrounds and containers for garbage storage in Belgorod were removed from protection zones of 6 kV cable lines, the storage of soil under a 10 kV overhead line in Borisovka was liquidated. In an unfavourable confluence of circumstances, a dangerous proximity to energy facilities could lead to an accident.
Individuals in the majority try not to bring the matter to court, but if it is a question of a ready structure, perpetrators leave it too late. At present, the decision of the Belgorod Regional Court on the demolition of a fence and farm building, erected by a resident of Ivnyansky district in the protection zone of a 10 kV overhead line, is being enforced. Disagreeing with the court decision, she appealed to the Supreme Court of the Russian Federation, which denied her satisfaction, indicating the legality of the judicial act.
The enforcement proceedings are also conducted on facts of court decisions on the demolition of a garage in the protection zone of an overhead line in Prokhorovsky district, a fence and a farm building in Shebekinsky district, a garage under power lines in Borisovsky district. To avoid such problems, starting construction, it is necessary to pay attention to the passage of power lines and, if any, agree in advance the work with IDGC of Centre - Belgorodenergo division.
In total, in 2017 Belgorodenergo revealed more than 300 facts of violations of protection zones of power lines. The most typical ones are land squatting with fencing of overhead lines, construction of buildings and outbuildings in the immediate vicinity of high voltage facilities, storage of soil and materials with violation of dimensions of overhead lines.
IDGC of Centre - Belgorodenergo division reminds that RF Government Resolution No. 160 of 24.02.2009 establishes a protection zone along overhead power lines in the form of a land plot and airspace bounded by vertical planes spaced on either side of outer wires of a line with their unbending position at a distance of 2 to 20 metres, depending on the voltage. Without coordination with the branch in this zone, any actions related to construction, reconstruction or demolition of buildings, storage of materials, development of soil are prohibited. It is strictly forbidden to place children’s and sports grounds, stadiums, markets, retail outlets and other facilities that provide for gathering of people; run aircrafts, plant trees or fish. On all issues related to electricity supply, it is necessary to apply to the direct line of IDGC of Centre at 13-50.
